This is an example of fees for our service and your recommended solicitors service.

No upfront Fees

You will never be asked to make any upfront payments for utilising our service. Our service is No Win No Fee.

If your claim is unsuccessful

You will never be asked to make any payment to us or your solicitor firm representing your claim if your case is unsuccessful and you have not failed in your obligations of keeping in contact with your solicitor and providing information when requested, or access to your house for professional services such as surveyors.

Fees if your claim is successful

If your claim is successful, you may receive compensation or other benefit relating to:

EXTRACTION – PROPERTY REPAIRS – RE-INSULATION

• Extraction of the insulation
• Remedial works to repair property damage caused by the failed insulation, this can be externally or internally or in the structure of your building.
• Re-install of insulation if your property is suitable and if you want it re-installed

You or your recommended contractor will receive the full amount of the award for the above. No deductions or fees are payable on this amount by you to Claims Legal or your representing solicitor.

OTHER COMPENSATION OR BENEFIT YOU MIGHT CLAIM AND RECEIVE

• Soft furnishings

Carpets, curtains, decoration, furniture etc – if you claim for these and receive compensation

• Kitchen and fixed furnishings

If your kitchen is damaged – if you claim for these and receive compensation

• Clothing and personal items

Any items damaged by insulation failure – if you claim for these and receive compensation

• Redecoration

Any efforts of redecoration you have made previously which is attributed to failed cavity insulation if you claim for these and receive compensation

• Energy Loss and Liability

Any claim for loss of promise, where you have not made the promised yearly savings since having cavity insulation installed; and also, extra heating costs because you are heating a damp home, or using extra energy using items such as dehumidifiers – if you claim for these and receive compensation

• Lost income

If you rent a room and because of damage caused by failed cavity insulation you are no longer able to do so and suffer a financial loss

• Any other successful claim and/or award that your representing solicitor successfully recovers for you in full or in part.

Any award for any of the above other compensation benefits of your claim, your solicitor firm will deduct 25% + VAT and pay this directly to Claims Legal Ltd.

Solicitors Fees

Your recommended solicitor will charge their fees directly to the defendant, which may be the contractor who installed your cavity wall insulation, or their insurer, or another individual, entity or insurer. Your solicitor makes no deductions from your compensation to pay for their work.

Your solicitor will advise you about insuring the claim with an After The Event insurance policy, (ATE).

Any professional services and costs provided by third parties such as Chartered Surveyors, your solicitor will recover the fees from the contractor who installed your cavity wall insulation, or their insurer, or another individual, entity or insurer.

Example:

Mr & Mrs Hoey said their house was damaged after failed cavity wall insulation and through the claim the Chartered Surveyors costed the extraction, repairs and re-install to a total figure of £15,900 + VAT

Mr & Mrs Hoey said they also had to replace 2 carpets which were damaged, 1 fitted wardrobe needed to be replaced, they had previously redecorated twice in the affected areas, and an expert energy report was requested which highlighted a liability to be claimed for.

Mr & Mrs Hoey’s solicitor received an offer of settlement from the insurer which they accepted.
